What is Medical Malpractice?
Medical malpractice occurs when a doctor or medical professional does not render the care that a reasonable doctor or professional would provide under similar circumstances. In legal terms, doctors and professionals must meet what is called the “standard of care.” Doctors and professionals are not required to provide the absolute best care. Rather, they must meet the minimal, reasonable standard.
What types of Damages are recoverable?
- Wrongful death In cases of wrongful death caused by medical malpractice, parents and children are entitled to compensation for the loss of love, affection, companionship, care, protection and guidance as a result of the loss of their family member. Parents and children are also entitled to recover for the pain, grief, sorrow, anguish, stress, shock, and mental suffering they have and will suffer.
- Survivors of medical malpractice In cases where the patient lives after medical malpractice, they can recover damages for such things as:
- out-of-pocket costs for additional medical procedures
- lost wages
- pain and suffering
- permanent injury
- loss of enjoyment of life
- disfigurement
- loss of companionship, love, or affection with spouse
